The courts of the sort set up in Sections 16 and 22 of the Fundamental Constitutions were not designed to oppress. Rather, they were intended to serve as conduits for addressing local concerns in an orderly fashion and for the preservation of communal rights, in accordance with local customs; a forum where the lord, in early modern fashion, condescended to hear the grievances of his tenants. They were also designed to maintain the connection— again as it was recognized at the time—between those granted power by virtue of their landholdings and those who, because they did not own land, would otherwise have remained voiceless and powerless.
